Terms of Service

These Terms of Service (the Terms) govern your use of bejagadget.com (the Site) and every purchase you make from Bejagadget. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy and Refund and Returns Policy. If you do not agree, please do not use the Site.

Who we are

Bejagadget is the trade name of THREAD HEARTH LLC, based in HARTVILLE, MO. Through this online store we sell Everyday Gadgets products.

Who may use the Site

You must be at least 18 years old, or use the Site with the consent of a parent or legal guardian. When you place an order, you agree to give accurate, current and complete information and to keep it up to date.

Your account

If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Tell us straight away at support@bejagadget.com if you suspect unauthorised access.

Products

Products are as described on their product pages. We may change, update or discontinue any listing at any time without prior notice. We try to present colours, sizes and details accurately, but small differences between screens and the actual product can occur.

Prices and taxes

All prices are shown in US Dollars (USD). Prices do not include applicable sales tax unless stated otherwise. The full cost of your order, including the product price, any shipping fee and taxes, is displayed at checkout before you confirm. We may change prices at any time, and we reserve the right to correct errors in prices or descriptions, including after an order has been placed; if that happens we will contact you before going further.

Orders

Your order is an offer to buy. We may accept or decline it, for example if an item is unavailable, if there is a pricing error or if we suspect fraud. If we cannot fulfil an order after payment, you will receive a full refund.

Cancelling an order

To cancel, contact us as soon as possible at support@bejagadget.com. Orders that have already been processed or shipped may not be eligible for cancellation.

Payment

We accept Shop Pay, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payments are processed securely at checkout by Shopify Payments. There are no hidden fees: every charge is shown before you confirm your purchase.

Shipping

We currently ship only within the United States, to all 50 states. International shipping is not available. Standard shipping is free on all orders, with no minimum. Processing times, delivery windows and tracking are explained in our Shipping Policy.

Returns and refunds

We accept returns for manufacturing defects, damage in transit or an incorrect item received. Eligibility, time limits and instructions are set out in our Refund and Returns Policy.

Using our products safely

Follow the instructions and care guidance given on each product page and with the product. Keep bladed kitchen tools away from children, and fit car accessories so that they never block your view, the airbags or the vehicle controls. Products must be used only for their intended purpose.

Acceptable use

When using the Site, you agree not to:

• take part in any unlawful or fraudulent activity;
• interfere with the security or operation of the Site;
• scrape, copy or reproduce Site content without our written permission;
• upload malicious software or harmful code;
• attempt to gain unauthorised access to any part of the Site.

Intellectual property

All content on the Site, including product images, text, logos and graphics, is owned by or licensed to Bejagadget and protected by intellectual property laws, including copyright and trademark law. You may not reproduce, distribute or otherwise use it without our prior written consent.

Disclaimer

The Site and products are provided on an as is and as available basis. We work to keep the Site accurate and reliable, but we do not guarantee that it will be uninterrupted, error-free or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, Bejagadget and THREAD HEARTH LLC are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or your purchase of products, including loss of data, revenue or profits.

Indemnification

You agree to indemnify and hold harmless THREAD HEARTH LLC, its members and service providers from any claim, loss or expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site.

Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.

Changes to these Terms

We may update these Terms from time to time. Changes are posted on this page with a new effective date. Continuing to use the Site after a change is posted means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the State of Missouri and of the United States. Any dispute arising from these Terms or your use of the Site will be resolved in the courts located in the State of Missouri.

Severability and entire agreement

If any part of these Terms is found invalid or unenforceable, the remaining parts stay in full force. These Terms, together with the policies referred to above, form the entire agreement between you and THREAD HEARTH LLC regarding the Site, and our failure to enforce any provision is not a waiver of it.
